Promotion’s General Terms and Conditions
“Pay with Visa” (the “Promotion”)
Below are the Terms and Conditions under which the promotional activity 'Pay with Visa' Get (hereinafter "the Promotion") will be developed and carried out. The persons wishing to participate (hereinafter "The Participant") recognize and accept that the development and execution of the Promotion will be subject solely and exclusively to these Terms and Conditions.
The Promotion is organized exclusively by QuickCart 2015 Limited ("the Organizer"), located at Aqueduct Flats, UWI Mona, Kingston 7, Jamaica and is sponsored by Visa, Inc. ("Visa"). The Organizer is solely and exclusively responsible for organizing the Promotion and offering the discount related to the Promotion.
PROMOTION MECHANICS
The following discounts will be provided to Participants who comply with these Terms and Conditions as part of the Promotion:
An eligible Visa cardholder will get free delivery when the Cardholder makes a purchase via the QuickCart website or app during the Promotion Period using his or her Visa Credit, Debit or Prepaid Card and enters the coupon code “VISA2024” during checkout and otherwise complies with the participation requirements provided in these Terms and Conditions.
An eligible Visa cardholder will get 5% cashback sent to his/her QuickCart wallet when the Cardholder places an order for 'Pickup' i.e. the type of order where the customer is expected to pick up his/her order from the merchant him/herself and where 'Pickup' is selected as the order type on the website or in the app. The Cardholder must complete the purchase using a Visa Credit, Debit or Prepaid Card in order to qualify.
The Promotion is valid during the promotion period which begins at 12 a.m. on Monday, May 27, 2024 and ends at 11:59 p.m. on Saturday, September 7, 2023 (the "Promotion Period").
FIRST: PARTICIPATION REQUIREMENTSIndividuals may participate in the Promotion if they comply with all of the following:
1. They possess a valid and active Visa (CREDIT, DEBIT/ PREPAID CARD)
2. They charge all services/products consumed/purchased from Organizer to the above mentioned Visa card(s)
3. They enter the coupon code
“VISA2024” during checkout (except for 'pickup' orders as those require no coupon code
4. They accept these Terms and Conditions
SECOND: ACCESS TO THE DISCOUNTTo access the discount which is the subject of this Promotion each Participant must agree that:
Participation in this Promotion occurs when Cardholders who are eligible in accordance with these Terms and Conditions make a Qualifying Transaction.
By receiving, using or accepting the free delivery and/or cashback benefits, Cardholder acknowledges to have read these Terms and Conditions and to have duly agreed to be absolutely bound by these Terms and Conditions.
Cashback expires 30 days after being issued and will be removed from the wallet after this period.
If a Cardholder's Card is terminated at any time for any reason, whether by the primary Cardholder or Cardholder’s Issuer, the Cardholder will forthwith be disqualified from participating in the Promotion and the free delivery/cashback benefit shall automatically and immediately be forfeited.
THIRD: PROMOTION LIMITS(i) Cardholders must be at least eighteen (18) years of age; and
(ii) Cardholder’s Card Account must be open, maintained with an Issuer, and the Card Account must be in good credit standing, as determined by Cardholder’s Issuer, in its sole discretion.
(iii) Promotion only valid for the areas serviced by QuickCart in Kingston and St. Andrew (Metropolitan Area), St. Catherine (Portmore), St. James (Montego Bay) and St. Ann (Ocho Rios), Jamaica.
FOURTH: CONSUMERS UNABLE TO PARTICIPATEThe following individuals cannot participate in the Promotion: Individuals under the age of 18 years old, are not eligible to participate in this Promotion.
FIFTH: ILLICIT OR FRAUDULENT ACTIVITIES AGAINST THE OPERATIONThe Organizer reserves the right to, in its sole discretion, invalidate any and all participation of any Participant, if the Organizer considers that the Participant has tried, or has effectively managed, to unlawfully or fraudulently manipulate the administration, security, equity and due execution of the Promotion.
SIXTH: OTHER LEGAL ISSUES1. The discount which is the subject of this Promotion is personal and non-transferable.
2. This Promotion cannot be combined with other discounts and / or promotions and is not redeemable for cash.
3. The Organizer is exclusively and directly responsible to the Participants for the quality of the products and / or services, as well as for compliance with all existing standards (during the Promotion Period) related to production, standards of health, marketing and use of the products / services that are the object of the Promotion. Visa does not provide any product and / or service, nor is responsible for the products or services that are the object of the Promotion, nor for human, technical or computer errors that cause the discount of this Promotion not to be received.
4. Neither Visa, nor its designees, nor assignees, nor any of their respective directors, employees, representatives and / or agents, will be liable for damages that are totally or partially due, directly or indirectly, to the acceptance of the products or services offered by the Organizer, including physical, mental or patrimonial damage, serious bodily injury or death.
5. By participating, it will be understood that the Participants have accepted these Terms and Conditions in their entirety.
6. These Terms and Conditions will be valid before the Organizer, independently of the proposals, offers and / or communications from the issuing banks, as well as third parties, directly related to these Terms and Conditions.
MODIFICATION OF THE TERMS AND CONDITIONSTo the extent permitted by the Jamaica legislation and if necessary, and / or at the discretion of the Organizer, the Organizer reserves the right to extend and / or clarify the scope of these Terms and Conditions, and / or any of the procedures, which will be communicated through the social networks and the Promotion website.
EIGHTH: AREA OF THE PROMOTION: Kingston and St. Andrew (Metropolitan Area), St. Catherine (Portmore), St. James (Montego Bay) and St. Ann (Ocho Rios), Jamaica.
NINTH: APPLICABLE LAWParticipants acknowledge and agree that the applicable law of any dispute arising in relation to the activity will be that of Jamaica and waives its right to initiate any type of claim in another jurisdiction.
